34-year-old Michael James Kirt was convicted in January 2008 for rape when he snuck into a middle school with a knife and duct tape, cornered a 12-year-old girl and raped her in the bathroom.
Almost immediately after he was convicted his attorneys filed for a new trial. A judge in Clarke County issued a ruling this past Tuesday to grant him a new trial.
