Another Tax plan

This was posted to the comments here last night, and although I find fault with some of it, it is a pretty thoughtful post. Looks like a canned response to anyone who supports that Fairtax bill, and I am sure has been posted to more than one website:

It is saddening to learn that there are so many who support the so called fair tax proposal. Perhaps those who support it have not had time to study the proposal in depth, its consequences, and then compare it to our founding father’s original tax plan to raise a federal revenue, which is the tax plan which a freedom loving people would support.

Not only is our founding fathers tax plan based upon a number of principles to disburse the costs of our federal government in a fair and equitable manner, but it also includes a number of necessary checks and balances designed to constantly encourage Congress to adopt sound fiscal and economic policies.

There are a number of half truths and outright inaccuracies being proffered by some of those who support the FT. For example, in an article titled ANSWERING A FAIR TAX QUESTION Neal Boortz wrote:

“It doesn’t matter that paying taxes will be voluntary under the Fair Tax plan. It doesn’t matter that nobody pays the retail sales tax on the basic necessities of life.”

But the truth is, all consumers pay the tax on the basic necessities of life under the so called fair tax. What Neal is referring to when he claims nobody pays tax on the basic necessities of life is the plan’s concocted “family consumption allowance“, a clever part of the proposal which is a monthly check given to each American household by government to offset taxes paid on the basic necessities of life by the household’s members..

In essence, the so called fair tax proposal rations tax-free basic necessities of life by the dollar amount of the family consumption allowance which will be given to each American household, and, the consequences in giving each American household a monthly government check is, it cleverly puts every American household on the government dole and makes the majority of Americans dependant upon this monthly government check. How nice!

What the fair tax proposal promises to do is give Senator Ted Socialist Kennedy a very valuable gift called the family consumption carrot, which he, and his socialist disciples in Congress will promise to increase during election time to buy millions of votes and remain in power, just as these socialists now do with the minimum wage, social security payments, aid to families with dependant children, and even corporate welfare___ the only difference is, the family consumption allowance promises to extend the tentacles of socialism to every American household in America with a monthly government check for their subsistence, completing the socialist takeover of America!

Were we not warned by Hamilton in the Federalist Papers that control over a man’s subsistence is a control over his will?

In addition to making American households dependent upon a monthly government check, the fair tax proposal expands the number of tax gathers to include individual tradesmen and entrepreneurs, and, even ordinary working people engaged in self employment, forcing them to all “register” with folks in government in order to pursue a livelihood [ see SEC. 502. REGISTRATION]. In short, the FT proposal would require these poor souls to become a modern-day regiment of enlisted tax gathers for government, increasing the number of tax gathers throughout the United States to an all time high, and compelling each to maintain burdensome and inquisitorial records and reports under a penalty of perjury [just as is now done with the income tax] to satisfy the wants and fancies of tyrants in government___ all the above to be implemented under the pretext of the “Fair Tax Reform“, a reform which promises to abolish the IRS and income taxation, but in substance and truth will only tighten the iron fist of government around the people’s productivity, while demanding the people to shamefully kneel to the iron fist of government, to receive their monthly government check .

Another glaring defect in the proposed legislation,H.R.25, and, S.1493 is, if adopted by the House and Senate today, legislation which would not bind a future Congress, and, Congress would be free to tinker with the proposal and manipulate it, just as is now done with the current system. It should also be noted that the architects of the Fair Tax proposal, to the best of my knowledge, have yet to propose any specific wording for a constitutional amendment which would, in a constitutional sense. preclude and forbid Congress from laying taxes calculated from “income”. But yet, the fair tax is pimped as a means to end income taxation!

Make no mistake, even if the 16th Amendment was repealed, as the architects of the FT promise, Congress would still have the constitutional authority to impose taxes calculated from income, impose taxes calculated from the profits and gains of corporations, from investments, impose death taxes, inheritance taxes etc., and do so under Congress’ power to lay excise taxes as established in the Flint vs. Stone Tracy Case, which was decided prior to the adoption of the 16th Amendment!

Absent a constitutional amendment being ratified with specific wording to forbid Congress to lay “any” tax calculated from profits, gains, interest, salaries, wages, tips etc., i.e, forbid any tax calculated from any lawfully realized money, but which the architects of the FT proposal are suspiciously not promoting, Congress will still maintain the dormant and residual power to calculate taxes from income via its power to lay an excise tax..

Why does Neal and so many others support the adoption of meaningless and unenforceable legislation containing utterances which amount to nothing more than a whimsical promise? Were we not warned by Thomas Jefferson: “In matters of Power, let no more be heard of confidence in men, but bind him down from mischief by the chains of the Constitution”?

So what should freedom loving Americans be promoting? A return to our Founding Father’s original tax plan which can be accomplished by a simple amendment to our Constitution to the effect that: The Sixteenth Amendment is hereby repealed and Congress is henceforth prohibited to lay any tax or burden which is calculated from profits, gains, interest, salaries, wages, tips, etc., i.e, forbid Congress to calculate any tax from any lawfully realized money.

Hell yes, something a democrat says that I can actually agree with. If the government would just enforce existing laws, and strengthen existing departments instead of creating new gigantic bureaucratic goat fucks they might actually get something done. It CAN be done, as the Minutemen project has shown us.

Counting down the days

   I am about a month overdue for my vacation and I can tell. As my wife would say, I am so stressed that I want to bite the heads off of little children. That would count about 90% of my damn employees because they are children in maturity if not fact.

   Don’t know if I am going to be going anywhere or not. I wanted to at least go to Savannah for a day or two, and maybe Jacksonville. Originally it was the Redneck Riviera, but I figure if I go down to the gulf a Hurricane would come along for sure. I had to put my car in the shop last month and paid for it on my Amex, and now the $1800 bill is due. I should have enough to pay it from my check this friday, but that means no damn money for two weeks. I think that Amex lets you roll purchases over $250 to the next month if you have to, so maybe I will pay half of it and go out of town for a day or two. Need the R&R.

   The really cool thing is that the way my days off go (6 on 2 off) this is my weekend off, I return Monday, and start my vacation on Tuesday. W00t!! I thought about trying to skate by with an 11 day vacation, but my boss won’t get a day off while I am gone, so I told her I would work for her Monday. Will still be like a vacation even working that day.

   Someone left an iPaq at work a couple of weeks ago. I have had it sitting in my safe since, waiting for someone to pick it up. Pretty soon and the damn thing will come home with me. It is a pretty sweet upgrade considering I have been using a Palm V forever. I’llo sell that bastard on eBay and use the ipaq. Very cool. Wifi, headphones, MMC card, etc.

Harry Potter Leaks

I have to say that I enjoy the Harry Potter books and eagerly await the release of the new one. Pretty entertaining, along the lines of C.S. Lewis’ Narnia series (at least in maturity level, if not content).

One thing that I have noticed is that since there is no new BIG news that seems to be forthcoming from Aruba, any news about Natalie or the search seems to be getting relegated (sp?) to somewhere other than the front page. I really hope that they don’t let this die down. Regardless of my nasty comments that are supposedly racist (although it is mostly white people that are calling me a racist) I do want to see her found, alive OR dead, so that her family can find some kind of closure.

Long holiday week

   I haven’t done much in the way of posting over the last week or so. I was off last friday, which was the only one in the last 14 days. I pretty much hate holidays, as I am usually pretty busy at work. Good for business, bad for lifestyle. Business has been pretty decent, which is nice because I haven’t lost too much to the store that opened 1.8 miles down the road from me. I was afraid of about a 20% loss in sales (which equates to about a 20% paycut), so I guess I am lucky in that respect.
   I flew my sister-in-law down from Portland for her vacation, it was nice to see her. Cheaper too, considering it was that or fly Stephanie AND some of the kids up there, and find daycare for whoever stayed here.
   Looks like Hurricane Dennis has been upgraded to a category 4. Had a shitload of rain here over the last week, so I am going to have to do some yardwork today before the next round. My neighbors above, and behind my house pretty much clear-cut their yards over the last two years, and since I live on a hill, I get all of their fucking top-soil when it storms. It’s bad enough that when it rains very hard, I get up to six inches of water rushing through my yard. Tore up several plants, wrecked two flower-beds, and fucked up my pond. Somehow, water gets under my pond liner, and forces EVERYTHING out. Luckily, most of the fish and plants survived. I went out and got a hard liner that I am going to put in today to solve that problem. It is slightly larger than the existing pond, so I am going to have to do a bit of digging. At least my 16 year old is, while I direct.
   I have felt like shit (literally) for most of the week. Been extremely constipated or something, so have been cramping like hell. I feel a little better today, but everything is relative. Between that and my fucking never-ending sinus infection, along with my cholesteral and ulcer, I am taking a pharmacopia of medicines. Don’t need to eat for all of the fucking pills I am taking.
   10 more days until my vacation. W00t! Don’t know if we will be going anywhere or not, due to the fact that it cost me $1400 to get my car out of the shop so that Stephanie and the kids could go to Hilton Head two weeks ago. I may be able to. I won a contest for a $750 travel gift certificate from work, but with my vacation being so close, I may not be abke to do anything with it yet. I may save it and try to take the kids to Disney World in October. One of the things I like about the changes to the school year is the creation of a fall break in October. Most of the heat of summer is gone, and it is much more comfortable doing just about anything.
